Boundary Disputes

If the boundaries on your land are unclear, it can potentially lead to disputes with neighbours, especially if either party is thought to be encroaching on the other. As Licensed Surveyors we’ll assess your site, re-establish the Title Boundary dimensions and location, physically mark out the boundaries, obtain existing land titles records and provide you with all the necessary legal documentation. This enables you to clearly see where your land starts and finishes to avoid issues both now and in the future.

Boundary Confirmation

Knowing exactly where your boundary lies before you commence any sort of building works on or near the edge of your property is a must. It allows you to avoid encroaching on your neighbour’s property as well as identifying any existing encroachments on your own land. If your property was fenced before you moved in, there’s often grey areas regarding the exact position of your boundary lines, and a site survey will clear up any confusion.

Whether you’re confirming your property lines to resolve a neighbourhood dispute, building a fence, home extension, driveway or other structure, or wish to subdivide your land, we’ll help you understand exactly where your boundary line is so you can move forward with confidence.

Boundary Realignment

If you require a boundary realignment on your property to rearrange Title locations or sizes, or a land swap with a neighbour, our team will help you through the process from start to finish to ensure it goes smoothly. Here’s an overview of how it works:

  • Site Survey: Our surveyors will conduct a site survey including measurements of the new boundary placement.
  • Plan of Subdivision: We will prepare a plan of subdivision, then forward it to you to review along with an owner’s consent form and payment request for the Council fees.
  • Council Lodgement: Once we receive the signed owner’s consent form and the Council fees are paid, we’ll lodge the plan with Council through the online SPEAR system. Council will assess the application and refer it to all the relevant servicing authorities such as electricity, water and sewerage. The authorities will respond to Council advising if any changes are needed on the plan (such as Easements, etc.) or if any works need to be completed onsite. Any changes or additional requirements will need to be completed before Council will give their consent by way of a Statement of Compliance. We’ll forward you the relevant forms and provide advice and support to ensure this step is completed as quickly as possible.

In addition, Council may include their own requirements, for example, relating to driveways, drainage, levies, etc.  If so, you’ll need to arrange for these items to be completed, and where necessary inspected. Once all the servicing authorities have consented to certification of the plan, the plan will be certified and we will be notified.

  • Abstract of Field Records: We will complete the required Abstract of Field Records and Surveyors Report ready for lodgement at Land Victoria. This process is completed electronically, and everything will be emailed to your conveyancer or solicitor once outstanding accounts are settled with us.
  • Statement of Compliance: Once the development works (driveways, drainage, etc.) are completed, all servicing authorities have given their consent and all Council permit conditions are satisfied, Council will issue the Statement of Compliance. This finalises all Council requirements and allows the plan of subdivision to be registered with Land Victoria.

We will send the Statement of Compliance and the accompanying survey documentation to your conveyancer or solicitor for lodgement and they can advise on the lodgement process and fees. As a guide, registration of the plan of subdivision with Land Victoria generally takes 14-21 business days.
